Terms of Service

1. Acceptance of Terms

By accessing or using Filmigrate (the "Service"), located at https://filmigrate.app/ or through any authorized client, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use the Service.

2. Description of the Service

Filmigrate is an interactive web application that provides world cinema tracking, 3D geographic film mapping across 200 countries and territories, Letterboxd CSV import compatibility, multi-device cloud synchronization, and cinema challenge discovery tools.

3. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. Filmigrate provides multi-device session management enabling you to revoke unauthorized active sessions at any time.

4. Merchant of Record, Subscription Billing & Cancellations

Our order process and payment processing is conducted by our authorized Merchant of Record, Lemon Squeezy (Lemon Squeezy LLC, a subsidiary of Stripe). Lemon Squeezy handles all payment transactions, international tax compliance, invoicing, currency conversions, and order fulfillment. When purchasing Filmigrate Pro, you agree to abide by Lemon Squeezy's Terms of Service.

Recurring Billing: Filmigrate Pro Monthly and Annual subscriptions automatically renew at the conclusion of each billing cycle at the prevailing standard rate unless cancelled prior to the renewal date.
One-Click Cancellation: You may cancel future renewals at any time via your account settings, through your Lemon Squeezy Customer Portal, or by emailing support@filmigrate.app. Cancellation prevents subsequent billing cycles while maintaining full Pro access until the conclusion of your current paid billing period.
Official Guarantee & Refunds: All purchases are governed by our Official Refund & Guarantee Policy, including our 48-Hour Technical Satisfaction Guarantee.

5. Intellectual Property & Third-Party Services

Filmigrate Brand: The 3D globe visualization engine, UI designs, brand emblems, and software code are proprietary property of Filmigrate.
TMDB Data: Film metadata, posters, and production countries are fetched via The Movie Database (TMDB) API. This product uses the TMDB API but is not endorsed or certified by TMDB.
Letterboxd CSV Import: Filmigrate is an independent tool providing interoperability with user-exported Letterboxd CSV data files and is not affiliated with or endorsed by Letterboxd Limited.

6. User Content & Data Portability

You retain full ownership of the movie logs, watchlists, ratings, and challenge lists you create on Filmigrate. We provide 1-click JSON data export at any time in the Account Settings → Data & Export panel.

7. Lifetime Founder Licenses & Fair Use Policy

"Lifetime" licenses grant perpetual access to all current and future core Filmigrate Pro features for the operational lifetime of the service with no recurring subscription fees. Licenses are granted for individual, non-transferable personal cinephile use. To ensure sustainable server infrastructure and prevent automated abuse, standard fair use capacity applies:

Multi-Device Cloud Sync: Up to 5 concurrent devices on Yearly plans, and up to 10 concurrent devices on Lifetime Founder licenses.
Cinema Library Capacity: Up to 25,000 titles on Yearly plans, and up to 50,000 logged movies & watchlist entries on Lifetime Founder licenses.
Challenge Itineraries: Up to 50 active custom challenge lists on Yearly, and up to 100 on Lifetime Founder.
Automated Metadata Queries: Standard fair use capacity applies to protect platform stability and infrastructure against automated scraping.

Accounts exhibiting automated bot scraping, distributed denial-of-service, or commercial resale without prior written agreement may be subject to rate limiting.

8. Limitation of Liability & Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Filmigrate shall not be liable for any indirect, incidental, special, exemplary, or consequential damages resulting from your use of the Service.

9. Dispute Resolution & Amicable Settlement

We are committed to customer satisfaction. Before initiating any formal legal claim, chargeback, or bank dispute, you agree to contact us first at support@filmigrate.app. Most billing inquiries, duplicate charges, or cancellation issues can be resolved amicably and promptly within 24 to 48 hours by our support team without protracted banking disputes.

10. Governing Law & Severability

These Terms shall be construed and governed in accordance with standard international commercial practices. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
